Donation items are not allowed to be scammed anywhere so that doesn't really count as a precedent.Shane recently looked into a IRC conversation when someone didn't return donation items that had been lent but never returned. He determined that since they were freely lent no scam occurred. I'm sure he will be looking into this one as well.
Scamming is allowed in-game as long as it doesn't have anything to do with dono items.seems like something every week..and yet theres always someone who sees no wrong doing.

SCAMMING Donation Items, or Donation Coins is prohibited. ANYONE found abusing this rule will face potential banning.
Mostly because this isn't carebear land (bad analogy I know) and UO is a game full of many things that can get you down if you let it. If you say something like fooling other players to give you things (aka scamming) should be removed/banned, then what happens to the other aspects of the game that are similar (e.g. Stealing, PKing, Looting)? UO players need to learn how to overcome (or avoid) such things as they are a part of the game. As always in UO, it is buyer beware.lol...never knew this, sounds like a joke to me....
thats why my pm was never answered about when i got scammed for a charcoal ethy llama and the guy xfered me a regular ethy llama.
